5/6/2004 38 DEFAULT JUDGMENT This action came before the Honorable Joseph F. Anderson, Jr., presiding, and the issues having been duly heard and briefed and a decision having been rendered, the court grants plaintiffs' motion for entry of default against defendant Robert Loetscher AG. IT IS ORDERED AND ADJUDGED that the plaintiffs, Swiss Army Brands, Inc. and Swiss Army Brand, Ltd. against defendant Robert Loetscher AG, in the amount of One Hundred Thousand and no/100 ($100,000.00) Dollars plus attorney's fees in the amount of Forty Thousand and no/100 ($40,000.00) Dollars. Post judgment interest shall accrue at the rate of 1.50% as provided by law. The defendant Robert Loetscher AG is permanently enjoined from selling or offering for sale products bearing the Swiss Army logo in violation of the Lanham Act. The court having been informed that an agreement of settlement has been reached as to claims against defendant Nayer Nassri; IT IS FURTHER ORDERED AND ADJUDGED that the plaintiffs, Swiss Army Brands, Inc. and Swiss Army Brand, Ltd. take nothing of defendant, Nayer Nassri and the complaint is dismissed with prejudice. The plaintiffs Swiss Army Brands, Inc. and Swiss Army Brand, Ltd. having withdrawn their claims against defendant Lotscher AG; IT IS FURTHER ORDERED AND ADJUDGED that plaintiffs Swiss Army Brands, Inc. and Swiss Army Brand, Ltd. take nothing of defendant Lotscher AG and the complaint is dismissed without prejudice.
