12/8/2003 7 CONSENT JUDGMENT AND PERMANENT INJUNCTION: 1)This is a Patent Infringement action; 2) Plaintiff alleges that Def has manufacutred and sold platens marketed under name of "Wyard's One Piece Molden Platen". 3) Court has subject jurisdiction ; 4) Def acknowledges that 073 patent is valid and enforceable. 5) Def acknowledges that is has infringed on one or more claims of the 073 patent by its mfr; 6) Def shall immediately discontinue the manufacturing, use, offer of sale of the platen; 7) Def acknowledges it has offered this platen for sale; 8) Def shall immediately commit to pruchase 2000 platens. 9) Nothing in this consent jgm shall be construed as a grant of any license by R.A. Jones under 073 patent; 10) Any violation of this consent will cause substantial injury; 11) This consent jgm shall be interpreted as if jointly written by both parties; 12) Both parties acknowledge an independent investigation of the facts 13) If any part of this agreement is illegal, it shall not be a part of this jgm; 14) Corporate representatives represent and warrant that they have full authority to execute this document; 15) This jgm shall be binding upon parties and successors; 16) Parties shall cuase this Entry of Dismissal to be filed, dismissing the claims of R.A.
